Divorce paperwork covers a lot of ground: the house, the cars, retirement accounts. Life insurance often gets mentioned almost as an afterthought, if it comes up at all. In North Carolina, that’s a mistake worth avoiding, because how your policy gets treated depends heavily on what kind of policy it actually is.<\/p>\n
Under North Carolina law, a term life insurance policy, the kind with no cash value, is generally treated as separate property, even if it was purchased during the marriage. That means the policyholder typically keeps full control over it, including who’s named as beneficiary.<\/p>\n
Whole life insurance works differently. Because it builds cash value over time, it’s generally considered a marital asset subject to equitable distribution under North Carolina General Statute 50-20, the same law governing how the rest of the marital estate gets divided.<\/p>\n
Divorce does not automatically remove an ex-spouse as a beneficiary on a life insurance policy. Unless the policyholder actively changes that designation, or a separation agreement specifically addresses it, the ex-spouse can remain listed as the beneficiary indefinitely, even years after the divorce is finalized.<\/p>\n
When a divorce involves alimony, child support, or a property settlement paid out over time, North Carolina courts and attorneys often build in protections in case the paying spouse dies before those obligations are met. This frequently means a life insurance policy naming the receiving spouse or children as beneficiaries, specifically to secure that future obligation. This isn’t automatic. It typically needs to be written into the separation agreement or court order directly.<\/p>\n
